Terms & conditions

These Terms & Conditions ("Terms") govern your use of Commr (the "Service"), operated by Jesse Williams (ABN 66 828 603 516) ("Commr", "we", "us"). By registering an account, scanning a business QR code, or otherwise using the Service, you agree to these Terms.

1. What Commr is

Commr is a local business partnership and customer discount network. Businesses form direct, one-to-one partnerships with each other. Customers verify with individual businesses by scanning a QR code and being approved. Once verified with a business, a customer may access discount offers made available by that business's partners.

Commr does not create, guarantee, or control the content of any offer. Offers are created and managed entirely by the participating businesses.

2. Accounts

You must provide accurate information when registering, whether as a business or as a customer. Businesses are responsible for the accuracy of their offers, partnership decisions, and approval of customers. You are responsible for keeping your login credentials confidential.

3. Customer verification and offers

  • Verification is granted at the sole discretion of each business.
  • Being verified with Business A does not entitle you to Business A's own offers — only to offers made available by Business A's confirmed partners, or to any offers Business A chooses to extend directly to its own verified customers.
  • Offers may be withdrawn, changed, capped in use, or expired at any time by the business that created them.
  • Redemption of an offer occurs in person at the business and is subject to that business's own conditions (e.g. minimum spend, exclusions).
  • Commr is not responsible for a business's refusal to honour an offer, and disputes about redemption are between the customer and the business.

4. Business partnerships

Partnerships between businesses are formed directly and can be ended at any time by either party. Ending a partnership does not retroactively revoke access already granted to customers who were verified while the partnership was active, unless the business chooses to remove that access.

5. Use of business marketing materials

By registering a business on Commr, you grant Commr a non-exclusive, royalty-free licence to use publicly available images and marketing materials associated with your business — including images from your business's own website, Facebook page, Instagram profile, or other public social media accounts — for the purpose of promoting your business within the Commr network, and for Commr's own marketing and promotional activities, including social media posts, the Commr website, and other promotional materials.

This licence covers only material your business has itself published or controls the rights to. It does not permit Commr to alter an image in a way that misrepresents your business, nor to sub-license it to any third party. You may request that Commr stop using a specific image at any time by contacting us, and we'll comply within a reasonable time. This licence continues for as long as your business remains part of the Commr network, and ends when your business account is deleted, except for material already published before that date.

6. Commr Pro (subscription tier)

Commr offers an optional paid subscription tier for businesses ("Commr Pro") priced at $9 AUD/month or $99 AUD/year. Pro unlocks additional features such as analytics, full redemption history, partner offer visibility, and the ability to send offers directly to your own verified customers. Core network functionality remains available on the free tier.

  • Commr Pro subscriptions are billed and managed via Stripe. By subscribing, you also agree to Stripe's terms where applicable.
  • New businesses receive a 14-day trial of Pro features with no card required. No charge occurs unless you actively subscribe after the trial.
  • Subscriptions renew automatically unless cancelled. You can cancel at any time via the billing portal; cancellation takes effect at the end of the current billing period.
  • Fees are non-refundable except where required by Australian Consumer Law.

Customers are never charged for using Commr, under any circumstances.

7. Acceptable use

You agree not to: misuse the QR verification system to register fraudulent accounts; attempt to access another business's or customer's account; interfere with the security or operation of the Service; or use the Service for any unlawful purpose.

8. Intellectual property

The Commr name, logo, and platform are the property of Jesse Williams (ABN 66 828 603 516). Business names, logos, and offer content remain the property of the respective business, subject to the marketing materials licence in Section 5 above.

9. Disclaimers and limitation of liability

The Service is provided "as is." To the maximum extent permitted by law, Commr disclaims all warranties regarding the accuracy, availability, or reliability of offers, partnerships, or the platform itself. Nothing in these Terms excludes any guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.

To the extent permitted by law, Commr's liability for any claim arising from use of the Service is limited to the amount you have paid us in the 12 months preceding the claim (if any).

10. Termination

We may suspend or terminate an account that breaches these Terms, engages in fraudulent verification, or misuses the platform. You may close your account at any time.

11. Changes to these terms

We may update these Terms from time to time. Where a change is material, we'll ask you to actively re-accept the updated Terms the next time you sign in, rather than treating continued use alone as acceptance.

12. Governing law

These Terms are governed by the laws of South Australia, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
